The ‘Judge’ is Hawke’s Bay Community Fitness Centre

Entry

• Entry into the competition is deemed to be acceptance of the Terms and Conditions and the Specific Rules and confirmation that the entrant has the necessary authority (for example from a parent if under 16) to enter the competition.
• No purchase is necessary to win or participate in the competition.
• The competition is open to all permanent residents of New Zealand, 15 – 18 years old.
• To enter the competition, you must complete the entry form on www.yoursolutions.co.nz
• All entrants must Like and Follow the Your Solutions Facebook page or Instagram page. Competition updates will be posted.
• Only one entry will be accepted per person, any subsequent entries will be disregarded.
• The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
• The Promoter reserves the right to exclude any person from participating in the competition on reasonable grounds.
• The Promoter reserves the right to refuse to award any prize to an entrant who the Promoter decides (in its sole discretion) has violated the Rules (including the Specific Rules), gained unfair advantage in participating in the competition or won using fraudulent means.
• By participating, entrants grant the Promoter exclusive permission to use their names, characters, photographs, videos and likeness in connection with the competition and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use.
• All entrant personal details must be valid and up to date and will be held by the Promoter and may be used for the purpose of the competition and for future promotion and marketing purposes unless otherwise directed by contestants at the time of entry.
• Personal information provided at the time of entry is presumed to be true and, in the case of text or email notification – active, through to and beyond the date of the Promotion’s completion.
• Entries close 31st January 2020, entries received after this time will be disregarded.

Winning the Prize

• Only the person who originally entered the competition can be awarded the prize (the ‘Winner’).
• The Winner will be determined in the manner set out in the Terms and Conditions or the Specific Rules.
• The Judge’s determination of the Winner will be final and no correspondence will be entered into.
• The Prize is not redeemable for cash or transferable. No other family members, friends, office associates or any other person will be able to participate on the Winner’s behalf.
• The prize is as stated, and no cash or other alternatives will be offered.
• The Winner takes the Prize entirely at his/her own risk and indemnifies the Promoter in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the prize. Where the Prize has associated terms and conditions the Winner accepts the Prize subject to those terms and conditions and restrictions.
• The Winner will be notified by email and/or letter within 28 days of the closing date. If the Winner cannot be contacted or do not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the Winner and pick a replacement winner
• The Promoter will advise the Winner on who to contact at the Hawke’s Bay Community Fitness Centre to arrange a start date for the High-Performance Development Programme
• The Winners details will be available 28 days after closing date by emailing the following address: info@yoursolutions.co.nz
• The Promoter takes no responsibility for any inability to enter, complete, continue or conclude the Promotion due to equipment or technical malfunction, busy lines, inadvertent disconnection, texts with a misspelt keyword, texts to an incorrect shortcode, Force Majeure or otherwise.
• To the fullest extent permitted by law the Promoter will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of competition entry or winning the prize.
• Where the Prize is to be supplied by an entity outside the Promoter’s control and that entity fails, for whatever reason, to supply the prize, the Promoter has no responsibility for the provision of the Prize and is not obliged to provide an alternative Prize or to take legal action to require the Prize supplier to provide the Prize.
• The Winner agrees to provide the Promoter with quarterly updates on progress and photos
• The Promoter reserves the right to cancel the competition if circumstances arise.
• The final 10 will be announced on the 10th February 2020 and the Winner will be announced 17th February 2020

Acceptance

Participation in the Competition is deemed acceptance of these Terms and Conditions.

If the Winner does not accept these Terms and Conditions the prize will be forfeited.

Specific Rules

The Promoter reserves the right to cancel the Prize if the Winner:

1. Has acted in a manner that is unprofessional and negative towards the Promoters brand
2. Isn’t meeting the requirements of the programme at Hawke’s Bay Community Fitness Centre
3. Isn’t taking the Prize/Programme seriously

Process for selecting the Winner

1. The Promoter will verify and shortlist the entries to the top 10
2. The Promoter will pass the top 10 entries on to the Hawke’s Bay Community Fitness Centre who will use the Athlete Development Selection Criteria and Process to select the Winner
